Canada’s inadmissibility fees to be updated as of December 1st, 2023

The Immigration, Refugees, and Citizenship Canada (IRCC) recently announced that as of December 1st, 2023, application fees for foreign nationals applying to regain their status or return to Canada after being inadmissible will be increased by Canada. The fees are being adjusted for inflation in accordance with the Service Fees Act.

The application fees are being adjusted for inflation in accordance with the Service Fees Act (SFA). These fees have been adjusted to account for inflation since 2018, and will continue to be adjusted annually for inflation every December 1st.

Applicants who submit their application after December 1st, 2023, have the chance to receive a partial refund known as a remission if IRCC does not meet its service standards. The remission will usually be issued by July 1st of the following fiscal year.

Admissibility requirements in Canada ensure that foreign nationals meet certain requirements before they are allowed to enter the country; these requirements include passing a criminal background check. In case a traveler has a criminal record, there are ways to overcome inadmissibility to Canada, in particular by applying for a Temporary Resident Permit (TRP), a Criminal Rehabilitation Application, or a Legal Opinion Letter.

A TRP grants temporary access to Canada for a certain period of time, whereas a Criminal Rehabilitation application permanently clears past criminal history for the purposes of entering Canada. The last option, a legal opinion letter, can help to pre-emptively avoid being found inadmissible to Canada by addressing the judicial authority hearing the case.
